Terms of Service

1. Acceptance of Terms

By accessing or using the 100fx service (the "Service"), provided by 100fx Studios ("Company", "we", "us", "our"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree, do not use the Service.

You must register for an account to access most features, providing accurate information including your full name, email address, and date of birth. You are responsible for keeping this information current.

2. Description of Service

The Service provides tools and resources for algorithmic trading, which may include trading signals, automated trading software ("bots" or "EAs"), educational materials, community access (e.g., Discord), and a dashboard. The dashboard allows you to view data from your linked trading accounts (e.g., MT4, MT5, CTrader, TradeLocker), such as balance, equity, and profit/loss history. Specific features depend on your subscription plan.

3. User Accounts

You are responsible for maintaining the confidentiality of your account password and for all activities under your account. Passwords are stored using secure hashing techniques. Notify us at legal@100fx.studio of any unauthorized access.

You represent that you are at least 18 years old. The Service is not intended for anyone under 18.

4. Subscriptions and Payments

Certain features require an active subscription. We offer plans such as "Lounge" and "Reserve" with monthly or annual billing. Fees are listed on our website or in the Service. We currently accept Wire Transfer, Revolut, and select Cryptocurrencies. Instructions are provided upon subscribing. Subscriptions may renew automatically unless cancelled before renewal. Manage or cancel by contacting support or via the Discord members channel. Unless required by law, fees are non-refundable.

5. License Grant and Restrictions

With an active subscription, we grant you a limited, non-exclusive, non-transferable, revocable license to access and use the Service and any provided software (e.g., EAs or bots) for personal, non-commercial trading.

You agree not to:

  • Copy, modify, distribute, sell, lease, or sublicense the Service or any part of it.
  • Reverse engineer, decompile, or extract source code from our software or algorithms.
  • Use the Service for illegal purposes or in violation of trading regulations.
  • Share your account access or license keys with others.
  • Interfere with or disrupt the Service's integrity or performance.

Linking trading accounts requires submitting a license request in the dashboard, providing account number, server, and platform details. Approval is at our discretion.

6. Disclaimer of Warranties and Trading Risks

HIGH RISK WARNING: Trading foreign exchange, cryptocurrencies, futures, options, and other financial instruments on margin carries a high level of risk and may not be suitable for everyone. High leverage can work for or against you. Consider your investment objectives, experience, and risk appetite carefully. You could lose some or all of your initial investment.

NO GUARANTEE OF PERFORMANCE: THE SERVICE (INCLUDING ALL SOFTWARE, SIGNALS, DATA, AND CONTENT) IS PROVIDED "AS IS" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, OR NON-INFRINGEMENT. 100FX STUDIOS DOES NOT GUARANTEE ACCURACY, COMPLETENESS, OR TIMELINESS OF INFORMATION, NOR ANY SPECIFIC RESULTS. PAST PERFORMANCE IS NOT INDICATIVE OF FUTURE RESULTS.

NOT FINANCIAL ADVICE: The Service is for informational and educational purposes only and does not constitute financial, investment, tax, or legal advice. 100fx Studios is not a registered investment advisor or broker-dealer. You remain solely responsible for your trading decisions and risk.

7. Limitation of Liability

TO THE FULLEST EXTENT PERMITTED BY LAW, 100FX STUDIOS AND ITS AFFILIATES, DIRECTORS, EMPLOYEES, OR LICENSORS WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING LOSS OF PROFITS, DATA, OR GOODWILL, ARISING OUT OF:

  • Your access or inability to access the Service;
  • Conduct or content of any third party on the Service;
  • Content or data obtained from the Service (including signals or bot performance);
  • Unauthorized access, use, or alteration of your transmissions, account, or data;
  • Losses from trading decisions made based on the Service;
  • Service interruptions, errors, or inaccuracies.

IN NO EVENT WILL 100FX STUDIOS’ TOTAL LIABILITY EXCEED THE AMOUNT YOU PAID FOR THE SERVICE IN THE PREVIOUS TWELVE (12) MONTHS, OR US$100, WHICHEVER IS GREATER.

8. Third-Party Services

The Service may integrate with or rely on third-party services (Brevo for email, MongoDB for hosting, MT4/MT5 for trading, Discord for community, etc.). Payment providers (e.g., Revolut) are also third parties. These services operate under their own terms. We are not responsible for their actions, content, or availability.

9. Intellectual Property

The Service, including software, algorithms, design, text, graphics, logos, and other content (except your personal trading data), is owned by 100fx Studios and its licensors, protected by intellectual property laws. No rights or licenses are granted except as stated in these Terms.

10. Privacy

Our collection and use of personal information is described in our Privacy Policy.

11. Modifications to Terms

We may modify these Terms at any time. If we make material changes, we will provide notice through the Service or by email at least 15 days before they take effect. Continuing to use the Service after the effective date constitutes your acceptance.

12. Termination

We may terminate or suspend your account if you breach these Terms. You may terminate at any time by contacting legal@100fx.studio. Upon termination, your right to use the Service ceases. Sections 6, 7, 9, 13 and any necessary provisions survive termination.

13. Governing Law and Dispute Resolution

These Terms are governed by the laws of your jurisdiction. Disputes will be resolved in the competent courts of that jurisdiction unless an alternative resolution is agreed upon.
